Article 1 – General
These General Terms and Conditions apply to all use of the Chicbylirette.com website (Website) and to all agreements concluded between you and Chic by Lirette.
Article 2 – Offers
2.1 All offers on the Website are non-binding, unless explicitly stated otherwise.
2.2 Chicbylirette.com cannot be held to its offers if you could reasonably have understood that the offer contains an obvious mistake or error.
2.3 The prices stated on the Website include VAT. A contribution to shipping costs will be stated separately to you prior to ordering. This contribution may depend on the order size. The contribution to shipping costs will not be refunded upon return.
Article 3 – Data
3.1 You must ensure that your data, including, but not limited to, e-mail address, address details, telephone number and bank account number, are complete, correct and up-to-date. You also guarantee that you are legally authorized to use the Website in any way.
3.2 Chicbylirette.com guarantees that all your data will be treated with the utmost care and that this data will not be passed on, resold or otherwise made available to third parties without your prior consent.
3.3 Chicbylirette.com will process your data and include it in its file to fulfill its obligations arising from the agreement it has concluded with you and/or to process your application. In addition, your e-mail address may be used to inform you about certain products and services of Chicbylirette.com that may be attractive to you. If you do not wish this, you can indicate this and unsubscribe at any time via the link mentioned in the newsletter.
3.4 You can always view and, if desired, change your own data on the Website.
Article 4 – Conclusion of the agreement
4.1 The agreement is concluded by Chicbylirette.com's receipt of your order.
4.2 Modification of an agreement is only possible if explicitly accepted by Chicbylirette.com.
Article 5 – Delivery
5.1 The order will be delivered to your home, unless you have indicated on the Website that the order should be delivered to a different delivery address. Shipping is on the same day if ordered on working days before 5:00 PM. The parcel services PostNL and GLS aim to deliver the next day. However, no rights can be derived from this.
5.2 You are obliged to take delivery of the purchased products at the moment they are made available.
5.3 If you refuse delivery or are negligent in providing information or instructions necessary for delivery, the products intended for delivery will be stored at your risk and expense.
5.4 If you have provided an incorrect address for delivery, the extra shipping costs will be for your account.
5.5 You have the right to cancel the agreement free of charge if the item has not yet been shipped. To do this, you must send an e-mail or letter to Chicbylirette.com. Any payments will in that case be refunded to you within 10 days of the notification.
Article 6 – Risk during transport
During the transport of the products, Chicbylirette.com will bear the risk in case of damage, theft or loss of the products. At the moment of delivery of the products, this risk will pass to you.
Article 7 – Cooling-off period
7.1 You are entitled to dissolve the agreement without stating reasons within 14 days after receipt of the relevant product. Chicbylirette.com will refund the amount paid by you within 30 days after receipt of the returned product, minus any return costs as stated on the website, provided that the relevant product is undamaged, not worn, washed or otherwise clearly used or processed and has the original packaging and (info) tags.
7.2 When using the return portal, a contribution of €3.95 will be deducted from the amount to be refunded.
If you choose your own shipping method, the return costs are entirely for your own account.
7.3 If you return a sale item, we will send you a shop credit for the value of the purchase amount.
Article 8 – Guarantees
8.1 Chicbylirette.com guarantees that the products to be delivered meet the specifications stated on the Website.
8.2 You must inspect the delivered product at the time of delivery, but in any case as soon as possible. You must investigate whether the quality and quantity of the delivered goods correspond with what has been agreed, or at least meet the requirements that apply in normal (commercial) traffic.
8.3 If it appears within 14 days after delivery that the products do not meet the specifications stated on the Website, Chicbylirette.com will ensure that the amount paid by you will be refunded within 30 days after receipt of the products. You can also, at your own discretion, ask Chicbylirette.com to replace or repair the relevant product. This warranty period is only longer if the manufacturer of the relevant product itself gives a warranty of more than 14 days.
8.4 After the warranty period mentioned in article 8.3, Chicbylirette.com is entitled to charge all costs for repair or replacement, including administration, shipping and call-out costs.
8.5 The warranty mentioned in this article lapses if the defect has arisen as a result of improper or inappropriate use or if, without the written permission of Chicbylirette.com, you or third parties have made changes or attempted to make changes to the relevant product or have used it for purposes for which the product is not intended.
Article 9 – Retention of title
Chicbylirette.com remains full owner of the delivered product until the purchase price has been paid in full.
Article 10 – Payment
10.1 During the conclusion of the agreement, you determine how you wish to pay. For example, you can choose to pay with IDEAL, Credit Card, Bancontact, Sofort, Paypal, Klarna or Fashioncheque
10.2 Chicbylirette.com will only proceed with the delivery of the product when payment has been made in full.
Article 11 – Intellectual property rights
11.1 The (intellectual property) rights with regard to the Website, including the rights to texts, images, design, databases, photos and other (still and/or moving) visual material, formats, software, brands (including domain names) and other materials, rest with Chicbylirette.com, its licensors, the manufacturers of the relevant products and/or third parties to whom Chicbylirette.com is not affiliated.
11.2 You may not make (parts of) the Website available to third parties in any way and/or reproduce them other than by downloading and viewing them on a single computer and/or printing one hard copy.
11.3 In addition, you may not make any changes to the delivered products, unless the nature of the delivered goods dictates otherwise or has been agreed otherwise in writing.
11.4 You may only place a hyperlink to the Website if this is done for purely informational purposes. Placing a hyperlink for any other purpose, such as a commercial purpose, is therefore prohibited.
Article 12 – Liability
12.1 If products supplied by Chicbylirette.com are defective, the liability of Chicbylirette.com is limited to what is regulated in these General Terms and Conditions under article 9 (Guarantees).
12.2 The liability of Chicbylirette.com for direct or indirect damage is in any case always limited to an amount equal to the purchase price of the defective product, unless the damage is due to intent and/or gross negligence, or improper or inappropriate use by yourself.
12.3 Chicbylirette.com hereby excludes all liability for any damage whatsoever, directly and/or indirectly, arising in any way from and/or resulting from the inability to use the Website, the fact that certain information on the Website is incorrect, incomplete or not up-to-date and the unlawful use of Chicbylirette.com's systems, including the Website, by a third party.
Article 13 – Force majeure
Parties are not obliged to fulfill any obligation if they are hindered from doing so as a result of a circumstance that is not attributable to their fault, and which is not for their account by virtue of law, a legal act or generally accepted views.
Article 14 - References
The Website may contain references (for example, by means of a hyperlink, banner or button) to the websites of third parties. Chicbylirette.com has no control over these websites. Chicbylirette.com is not responsible for the content of these websites.
Article 15 - Miscellaneous
15.1 Any deviations from these General Terms and Conditions can only be agreed upon in writing. No rights can be derived from such deviations with regard to later legal relationships.
15.2 The administration of Chicbylirette.com serves, subject to proof to the contrary, as proof of the applications and/or orders placed by you. You acknowledge that electronic communication can serve as proof.
15.3 Chicbylirette.com is entitled to transfer the rights and obligations from the agreement with you to a third party by means of a single notification to you.
15.4 If and insofar as any provision of the General Terms and Conditions is declared null and void or annulled, the remaining provisions of these General Terms and Conditions will remain in full force and effect. Chicbylirette.com will then determine a new provision to replace the null/annulled provision, whereby the purport of the null/annulled provision will be taken into account as much as possible.
Article 16 - Applicable law and competent court
Dutch law applies to these General Terms and Conditions. All possible disputes will be submitted to the competent court in Amsterdam. These General Terms and Conditions can be adjusted by Chicbylirette.com at any time. Chicbylirette.com therefore advises you to consult the General Terms and Conditions regularly.
